These Terms of Service ("Terms") govern your use of this store, your purchase of products through this store, and any related services offered by META PC, LLC, an Arizona limited liability company doing business as "META PCs" ("META PCs," "we," "us," or "our"). By accessing this store, creating an account, or placing an order, you agree to these Terms.

If you do not agree to these Terms, do not use this store or purchase any products through it.

1. Eligibility and Account

1.1 Age Restriction

This store is intended for use by individuals 18 years of age or older. If you are under 18, you are not permitted to use this store or place an order.

1.2 Account Information

You may be required to create an account to place an order, manage purchases, or access certain features. You agree that all information you provide during account creation and at checkout is accurate, current, and complete, and you will keep your account information up to date.

You are responsible for maintaining the confidentiality of your account credentials and for any activity that occurs under your account. We are not liable for any loss arising from unauthorized access to your account, and we may rely without investigation on any login made with your credentials.

We may suspend or terminate your account at any time, with or without notice, if we determine in our sole discretion that you have provided inaccurate information, breached these Terms, or otherwise misused the store.

1.3 Authority to Bind

If you are entering into these Terms on behalf of a company or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms.

2. Products, Pricing, and Orders

2.1 Pricing

All prices are listed in US Dollars (USD) unless otherwise stated. Prices do not include shipping, handling, or applicable taxes unless explicitly indicated. We may change prices at any time; the price in effect at the time you place your order is the price you will be charged.

2.2 Pricing Errors

We make every effort to display accurate pricing, but typographical errors or system errors can occur. We reserve the right to cancel any order placed at an incorrect price, even after order confirmation. If a product's correct price is lower than the listed price, we will charge the lower price. If the correct price is higher, we will notify you and give you the option to confirm at the corrected price or cancel for a full refund.

2.3 Product Availability

All sales are subject to availability. We may revise, discontinue, or limit the quantity of any product at any time without notice. If an item you ordered becomes unavailable, we will notify you with an estimated restock date or offer a refund of that line item.

2.4 Accuracy of Product Information

We make reasonable efforts to describe and display our products accurately, but cannot guarantee perfect accuracy of product photos, specifications, or component details. Component substitutions of equivalent or better spec may occur on custom builds as parts move in and out of inventory. Material substitutions will be communicated before the system ships.

2.5 Order Acceptance

An order confirmation email is sent automatically when you submit an order. This email confirms only that we received your order, not that we have accepted it. We reserve the right to refuse, cancel, or limit any order for any reason, including suspected fraud, unavailable inventory, pricing errors, or restrictions on shipping destination. If we cancel an order you have already paid for, you will receive a full refund.

2.6 Payment Authorization

By providing your payment method and submitting an order, you authorize us to charge the full order total — including products, applicable shipping, and applicable taxes — to that payment method immediately upon order submission.

2.7 Third-Party Financing

We offer financing through third-party providers (e.g., Affirm, PayTomorrow, Bread, Progressive, Katapult). If you choose to finance your order, you enter into a separate agreement directly with that financing provider on their terms. We are not a party to your financing agreement and have no liability for any aspect of the financing arrangement.

For any cancellation or return of a financed order, the merchant-processor fees and financing fees we incurred at the time of sale will be deducted from your refund.

2.8 Taxes

You are responsible for any applicable sales, use, or value-added taxes. If we are required to collect tax at checkout, the tax amount will be added to your order total. Valid tax-exemption certificates must be on file with us before you place a tax-exempt order.

3. Shipping, Returns, and Warranty

The following are governed by separate policies, incorporated into these Terms by reference:

The Return & Refund Policy and the Lifetime Support Warranty are the exclusive remedies available to you for product issues. Subject to applicable consumer protection laws, all other warranties, express or implied, are disclaimed as described in Section 6.

4. Product Use Restrictions

Products purchased from this store are for your personal, internal use only. Resale, sublicensing, or commercial redistribution of products purchased from us is not permitted without our prior written consent.

You are solely responsible for compliance with any laws applicable to your purchase and use of any products. We make no representation that the products are legal in your jurisdiction.

Safety: Never charge your notebook or PC while it is resting on fabric, bedding, upholstery, or any other surface that can block airflow or trap heat. Doing so creates a fire risk.

5. Software and Third-Party Components

All software included on or with hardware you purchase from us is licensed (not sold) to you by the applicable software licensor, and is subject to that licensor's end-user license agreement. By opening the software packaging or first booting the system, you accept the licensor's terms. Title to all software remains with its respective licensor.

We provide no warranty of any kind on third-party software preinstalled on or accompanying any hardware. Warranty terms for third-party software, if any, are provided by the licensor.

Most third-party hardware components we resell carry the manufacturer's own warranty (typically one year). We will assist with the manufacturer RMA process on your behalf where reasonably possible. We are not the warranty obligor on third-party components.

6. Disclaimers

Except for the express written warranties offered by us in our Lifetime Service & Support Warranty, the products and this store are provided "AS IS" and "WITH ALL FAULTS," and we disclaim all other warranties of any kind, whether express, implied, or statutory — including but not limited to the implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty arising from course of dealing or usage of trade.

Without limiting the above, we make no warranty:

  • That the store will be available, uninterrupted, error-free, or secure;
  • That any product will meet your specific requirements or expectations;
  • That data on any storage device returned for service will be preserved (see the Return & Refund Policy's data notice);
  • Regarding the accuracy or completeness of any information on the store.

Some jurisdictions do not allow the exclusion of implied warranties or limitations on certain warranties. To the extent applicable in your jurisdiction, the duration and scope of any implied warranty we cannot disclaim is limited to the shortest period and narrowest scope permitted by law.

7. Limitation of Liability

To the maximum extent permitted by applicable law, META PCs and its members, managers, officers, employees, affiliates, and agents will not be liable to you for any indirect, special, incidental, consequential, exemplary, or punitive damages — including lost profits, lost revenue, lost data, lost goodwill, or business interruption — arising out of or related to these Terms, your use of the store, or any product purchased from us, even if we have been advised of the possibility of such damages.

Our total cumulative liability to you for any direct damages, regardless of legal theory, will not exceed the amount you actually paid us for the specific product giving rise to the claim.

You acknowledge that you may be waiving rights with respect to claims that are unknown or unsuspected. To the extent applicable, you waive the benefit of California Civil Code § 1542 and any similar law of any other jurisdiction.

Some jurisdictions do not allow the exclusion or limitation of certain damages. To that extent, the limitations above will apply to the maximum extent permitted by law.

8. Indemnification

You agree to defend, indemnify, and hold harmless META PC, LLC and its members, managers, officers, employees, agents, and representatives from any claims, liabilities, damages, losses, and costs (including reasonable attorneys' fees) arising out of or related to: (i) your breach of these Terms; (ii) your use of any product purchased from us; (iii) your violation of any third party's rights, including intellectual property rights; or (iv) your negligent or willful acts or omissions.

We reserve the right to assume the exclusive defense and control of any matter otherwise subject to your indemnification, in which case you will cooperate with our defense.

9. Intellectual Property

9.1 Our IP

All logos, trademarks, trade names, service marks, product names, page layouts, graphics, photos, text, video, and other content on this store ("Materials") are owned by us or used under license. The look and feel of this store is protected trade dress.

Except as expressly permitted in these Terms, you may not copy, reproduce, distribute, republish, modify, frame, scrape, mirror, or create derivative works of any of the Materials without our prior written consent. Use of meta tags or other hidden text containing our name or marks is prohibited.

9.2 Third-Party IP

References on this store to third-party trade names, trademarks, product names, or service marks (such as Intel®, AMD®, NVIDIA®, etc.) are used for identification purposes only. No affiliation, sponsorship, or endorsement is implied by such references unless expressly stated.

9.3 User Submissions

Any review, comment, photo, or other content you submit through this store (a "Submission") is not confidential and may be used by us, royalty-free, for any business purpose including marketing, with attribution to the username you provide. Do not submit confidential information.

10. Email and Marketing Communications

We comply with the CAN-SPAM Act of 2003. By creating an account, placing an order, or opting in, you consent to receive transactional emails (order confirmations, shipment notices, RMA correspondence) and, if you have opted in, marketing communications.

You can opt out of marketing emails at any time by clicking "unsubscribe" in any marketing email or by emailing support@metapcs.com. Opting out does not affect transactional emails relating to your account or orders.

11. Prohibited Conduct

You may not, in connection with the store or any product:

  • Engage in fraud or attempted fraud (including chargeback abuse)
  • Reverse-engineer our checkout, configurator, or back-end systems
  • Use the store to violate any law or third-party right
  • Scrape, harvest, or systematically extract data from the store
  • Interfere with the operation of the store, including by submitting malware, denial-of-service traffic, or excessive automated requests
  • Misrepresent your identity, age, or affiliation
  • Use the store for resale or distribution outside the permitted-use scope (Section 4)

We may terminate your access for any prohibited conduct without notice and pursue all available legal remedies.

12. Affiliate Program

We operate an affiliate program with separate terms. If you participate as an affiliate, your participation is governed by our Affiliate Terms, which you must accept as a condition of approval. Affiliate Terms are provided at the time of registration.

13. Dispute Resolution and Arbitration

Please read this section carefully — it limits how you can resolve disputes with us.

13.1 Informal Resolution

Before filing arbitration, you agree to attempt to resolve any dispute informally by emailing support@metapcs.com with a written description of the dispute and your contact information. We will respond within 30 days. If we cannot resolve the dispute informally within 60 days of your written notice, either party may proceed to arbitration.

13.2 Binding Arbitration

Except for the carve-outs in Section 13.4, any and all disputes, claims, or controversies arising out of or relating to these Terms or your purchase or use of any product — whether based in contract, tort, statute, or any other theory — will be resolved by final, binding, individual arbitration under the then-current rules of the American Arbitration Association ("AAA"), administered by the AAA.

13.3 Venue and Procedure

Arbitration will be held in Maricopa County, Arizona, or remotely if both parties agree. The arbitrator will have authority to grant any relief available in law or equity, except punitive damages, which neither party may seek. The arbitrator's decision will be final and may be entered as a judgment in any court of competent jurisdiction. The arbitrator may award reasonable costs and attorneys' fees to the prevailing party.

13.4 Carve-Outs

The arbitration requirement does not apply to: (i) actions to protect intellectual property rights (which may be brought in state or federal court); (ii) small-claims-court actions for amounts within that court's jurisdictional limit; (iii) enforcement of an arbitration award.

13.5 Class Action Waiver

Disputes must be brought in your individual capacity, not as a plaintiff or class member in any purported class, collective, or representative proceeding. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding.

13.6 Notice Period for Claims

Any written notice requesting arbitration must be sent to us within one (1) year after the act or occurrence giving rise to the claim. Claims not noticed within one year are waived.

13.7 Jury Trial Waiver

By agreeing to arbitration, both you and we waive any right to a jury trial on any dispute covered by this Section.

14. Governing Law

These Terms are governed by the laws of the State of Arizona, USA, without regard to conflict-of-laws principles and without regard to the United Nations Convention on Contracts for the International Sale of Goods.

15. Privacy

Your use of this store is also governed by our Privacy Policy, which describes how we collect, use, and share your information.

16. Changes to These Terms

We may update these Terms from time to time. The current version is always posted at the link in the footer, and the "Last updated" date at the top reflects the most recent change. Material changes will be highlighted at checkout or via email to registered account holders.

Your continued use of the store after changes become effective constitutes acceptance of the revised Terms. The version in effect at the time you place an order governs that order.

17. Termination of the Store

We may modify or discontinue the store, in whole or in part, at any time, with or without notice. We are not liable to you or to any third party for any modification, suspension, or discontinuation of the store. Sections of these Terms that by their nature should survive (including Sections 6, 7, 8, 13, and 14) will survive termination.

18. General

18.1 Entire Agreement

These Terms, together with the Return & Refund Policy, Shipping Policy, Privacy Policy, and Lifetime Support Warranty, constitute the entire agreement between you and us regarding your purchase and use of any product from this store. They supersede any prior agreements or communications on the same subject.

18.2 Severability

If any provision of these Terms is held invalid or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.

18.3 No Waiver

Our failure to enforce any provision of these Terms is not a waiver of that or any other provision.

18.4 Assignment

You may not assign or transfer any of your rights or obligations under these Terms without our prior written consent. We may assign these Terms freely.

18.5 Force Majeure

Except for your payment obligations, neither party is liable for any delay or failure to perform caused by events beyond its reasonable control, including natural disasters, war, civil unrest, government actions, labor disputes, supply-chain interruptions, internet/utility outages, and pandemics.

18.6 Headings

Section headings are for convenience only and have no contractual effect.

18.7 Communications

By using this store, you consent to receive electronic communications from us, and you agree that any such communications satisfy any legal requirement that the communication be in writing.
